Covered Balcony

My Client, the landlord, is building out 2 covered balcony's for the tenant. The landlord feels like since the covered balcony is within the tenant's suite and used by only the tenant, that it should be part of their occupant area. Can we include this new covered balcony in occupant area? The building is in Dallas, TX.

If it's not fully enclosed, it cannot be included in the Occupant Area.
